How to file a complaint in consumer court?

You have been duped, ignored, insulted or cheated while buying a product. You want to file a complaint in the consumer court. Well, that is your right granted to you under Consumer Protection Act. But the decision to file the complaint should not be a emotional decision and you should not have high expectations from consumer courts. Whatever the Govt. claims, the legal system in India is not complainant friendly and this includes consumer courts also. So, keep your emotions aside and be rational while preparing to file the complaint and in legal battle ahead.

Consumer v/s Customer

Normally people will use terms 'Consumer' and 'Customer' in the same sense but under Consumer Protection Act both these terms have different meanings. A consumer is protected under this Act but not the customer. In a general sense, if you buy a product for any commercial purposes you are not a consumer, but if you buy the product purely for your own consumption, you are a consumer.

Not providing information under RTI Act is deficiency in service under CPA

There is good news for those information seekers under RTI Act, who inspite of their best efforts and intentions are not provided information by CPIO. The issue whether failure to furnish information without valid reason constitutes a deficiency in service for which compensation can be sought by filing a consumer complaint has been decided by the National Consumer Commission in a trendsetting judgment.

An applicant under the RTI Act has to pay fees for getting the information, and hence he acquires the status of a consumer. If there is any deficiency in service in respect of providing such information, a complaint could be filed under the CPA for claiming compensation. This landmark and historic judgment is a new milestone, both for RTI as well as consumer activists, for holding the authorities accountable to the citizen.

Sharad Pawar's ministry compromises interest of Indian Consumer - BIS Registration Scheme notified

Details of the registration scheme (closely guarded secret of DOCA and BIS) are now available in BIS Rules, 1987. A new chapter IV A has been inserted. Notification issued in this regard will posted on the blog shortly. This notification has been merged in the BIS Rules.

From first hurried reading the only term comes to my mind is - stupid piece of legislation. I will like to know, which stupid person drafted this.

Registration Scheme is nothing but distorted image of Product Certification Scheme. By notifying this scheme, Ministry of Consumer Affairs has compromised the interest of Indian Consumer.

BIS Product Certification is based on ISO/IEC Guide 28 which

gives general guidelines for a specific product certification system.

It is applicable to a third-party product certification system for determining the conformity of a product with specified requirements through initial testing of samples of the product, assessment and surveillance of the involved quality system, and surveillance by testing of product samples taken from the factory or the open market, or both. ISO/IEC Guide 28:2004 addresses conditions for use of a mark of conformity and conditions for granting a certificate of conformity.

BIS Product Certification scheme was first distorted by Simplified Procedure and now further distorted by this scheme. All essential elements like

determining the conformity of a product with specified requirements through initial testing of samples of the product, assessment and surveillance of the involved quality system, and surveillance by testing of product samples taken from the factory or the open market, or both, are missing in this Registration Scheme.

Why first BIS and now BIS plus ministry are out to compromise the interest of the consumer? All controls on manufacturers

are being

relaxed one after the other. Appointment of agents, grant of licenses based on the report of chartered engineer, recognizing self-test report and now this registration scheme are all to please the manufacturers and sacrifice the interest of the consumer.

President's Secretriat Helpline - No real help to consumer

There are many helplines to help aam aadmi, but poor aam aadmi never gets any help. When President's Secretariat started a helpline I registered a grievance on 28th July 2009 about RTI Act. Whenever I checked the status, it said that a letter/e-mail will be sent to me separately. The letter/e-mail never arrived. I registered a reminder grievance on 06th October 2009. Today I checked the status. It says my grievance is under examination.

On 29th July 2009, I registered another grievance about pathetic condition of DDA District Park in Paschim Puri. As per the status shown on helpline website, my petition was transferred on 18th August 2009 to Shri Rakesh Mohan, Principal Secretary (AR), Delhi Sectt. I did not hear anything from PS (AR). I sent an e-mail to PS (AR) which was not replied. I phoned his office and was told that Shri Rakesh Mohan is not PS (AR). With being directed from one phone number to another, I finally got in touch with a Section Officer where I was informed that President's Sectt has wrongly transferred the petition to Delhi Sectt as DDA is not under Delhi Govt. He gave me address of some website where these details are posted, but that website never opened. I returned to President's Secretariat Helpline. Today I checked the status. It says my grievance is under examination.

It is no use. Poor aam aadmi can not do any thing. They only shout to help aam aadmi, but aam aadmi never gets any help.

जनता के पैसे का अपराधिक दुरूपयोग

कुछ समय पहले मैंने अपने ब्लॉग काव्य कुञ्ज पर एक पोस्ट लिखी थी - मीठा-मीठा मैं, कड़वा-कड़वा तू. इस पोस्ट में मैंने लिखा था कि दिल्ली में जो कुछ अच्छा होता है उस का श्रेय शीला दीक्षित ले लेती हैं. अखवारों में शीला जी की तस्वीर के साथ एक विज्ञापन छप जाता है. जो बुरा होता है उस की जिम्मेदारी दूसरों पर डाल दी जाती है. कभी नगर निगम तो कभी बाहर आकर दिल्ली में बसे लोग और कभी दिल्ली वालों पर.

अखवार में ऐसे विज्ञापन जनता के पैसे का निजी स्वार्थों का दुरूपुओग करके छापे जाते हैं. आज जिस खबर की फोटो मैंने यहाँ छापी है उस के अनुसार लोकायुक्त ने जनता के पैसे का इस तरह दुरूपयोग करने के लिए एक नोटिस जारी किया है. आप को अखवारों में शीला जी के बारे में जो अच्छी खबरे मिलेंगी उन सब में शीला जी की फोटो जरूर होती है, पर इस खबर में शीला जी की फोटो नहीं है. है न मजेदार बात. अगर जनता और नेता के बीच में किसी को चुनना हो तो ज्यादातर अखवार वाले नेता को चुनते हैं. इसे क्या कहेंगे, मजेदार बात या जनता के साथ विश्वासघात?

जनता का पैसा केंद्र सरकार भी खूब उडाती है इस तरह के विज्ञापनों में. खूब जम कर विज्ञापन छपते हैं मंत्रियों और उनकी मालकिन की फोटो के साथ. मेरे विचार में ऐसा ही एक नोटिस प्रधान मंत्री और मंत्रियों को भी भेजा जाना चाहिए.

सरकारी हेल्पलाईन - आम आदमी को बेबकूफ बनाने का यंत्र

दिल्ली की मुख्यमंत्री, शीला दीक्षित, ने पिछले तीन चुनाव जीत कर अगर कुछ सीखा है तो वह है आम आदमी को किस तरह बेबकूफ बनाया जाय. सच कहा जाय तो आम आदमी को बबकूफ़ बना कर ही उन्होंने यह चुनाव जीते हैं. भारतीय राजनीति भी अजीब है, इसमें आम आदमी को जो पार्टी सबसे ज्यादा बेबकूफ बना दे वह जीत जाती है. इसमें शीला जी ने जो महारथ हासिल कर ली है वह किसी भी प्रकार से मायावती से कम नहीं है. यह दोनों महिलायें महान हैं. उत्तर प्रदेश में मायावती जी, और दिल्ली में शीला जी. मायवती जी अपनी मूर्तियाँ बनबाती हैं. शीला जी रोज सरकारी विज्ञापनों में अपनी फोटो छपवाती हैं. दोनों अपने-अपने तरीकों से आम आदमी को खूब बेबकूफ बनाती हैं.

आम आदमी को बेबकूफ बनाने के अपने अभियान में शीला जी ने कल एक और अध्याय जोड़ा जब दिल्ली में एक और हेल्पलाइन शुरू की गई. इस हेल्पलाइन को मुख्य मंत्री के 'कान और आँख' का नाम दिया गया है. यानी कि अब मुख्य मंत्री आम आदमी के कान और आँख से देखेंगी. इस का मतलब यह नहीं है कि मुख्य मंत्री के कान और आँख ठीक से काम नहीं कर रहे. वह ठीक ठाक काम कर रहे हैं, पर सारा समय वह इन्हें अपनी और अपनी पार्टी की स्वार्थसिद्धि के लिए प्रयोग करती हैं. आम आदमी के लिए अब वह आम आदमी के कान और आँख प्रयोग करेंगी. 'अपने हाथ मुझे दे दे ठाकुर' गब्बर ने कहा था. 'अपने कान और आँख मुझे दे दे आम आदमी' शीला जी ने कहा.

सब कुछ समझते हुए मैं भी बेबकूफ बन गया. कल मैंने काफी समय नष्ट किया मुख्य मंत्री के कान और आँख बनने के लिए पर जब भी फोन मिलाया यही आवाज आई - लाइन व्यस्त है, कुछ देर बाद फोन करें. हार कर सो गया. आज सुबह अखवार में पढ़ा कि ७० आम आदमी बेबकूफ बनने में कामयाब हो गए. ज्यादा आम आदमियों को जो बेबकूफी की वह नगर निगम द्बारा बेबकूफ बनाने से सम्बंधित थीं. अब इसका इस्तेमाल करेंगी शीला जी, नगर निगम पर अपना अधिकार हासिल करने के लिए. आम आदमी तो परेशान है और परेशान रहेगा. देखा फिर बना दिया न शीला जी ने आम आदमी को बेबकूफ. हो सकता है कामनवेल्थ खेलों के बाद सोनिया जी उन्हें भारत रत्न की उपाधि से सम्मानित भी कर दें. आखिरकार शीला जी उनके लिए भी तो आम आदमी को बेबकूफ बनाने का काम कर रही हैं.

आप धन्य हैं शीला जी. मुझे भी बेबकूफ बना दिया. सब को समझाता हूँ पर खुद बेबकूफ बन गया. लगा रहा घंटों फोन पर. यही तो महानता है शीला जी आपकी. फिल्म निकाह में एक गाना था - शायद उनका आखिरी हो यह सितम (बेबकूफ बन्नाना), हर सितम यह सोच कर हम सह गए (बेबकूफ बन गए).

Government, product and service providers in India have invented many ways to harass Indian citizens.

Electronic energy meters are under mandatory certification under Bureau of Indian Standards Act. All energy meters have to be marked with ISI mark under BIS Product Certification Scheme. Under this scheme, meters are regularly drawn from factories and market and tested by BIS in independent laboratories. I do not understand how faulty meters are purchased by discoms.

As far as walking on Delhi roads is concerned, you are lucky if you are back home in one peace. Shiela Dikshit calls it a world class city, Chidambaram calls it a big and good international city and advises Delhi citizens to behave.
